Digital Millennium Copyright Act Policy

Welcome to hazelsocialmedia.com (the Site). We respect the intellectual property rights of others just as we expect others to respect our rights. Pursuant to Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their agent may submit a takedown notice to us via our DMCA Agent listed below. As an internet service provider, we are entitled to claim immunity from said infringement claims pursuant to the safe harbor provisions of the DMCA. To submit a good faith infringement claim to us, you must submit notice to us that sets forth the following information:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner (or someone authorized to act on behalf of the owner);
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the infringing material to be removed, and information reasonably sufficient to permit the service provider to locate the material. Please submit the URL of the page in question to assist us in identifying the allegedly offending work;
  4. Information reasonably sufficient to permit the service provider to contact the complaining party including your name, physical address, email address, phone number and fax number;
  5. A statement that the complaining party has a good faith belief that the use of the material is unauthorized by the copyright agent; and
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Title 17 USC §512(f) provides civil damage penalties, including costs and attorney fees, against any person who knowingly and materially misrepresents certain information in a notification of infringement under 17 USC §512(c)(3).

Please note that we may share the identity and information in any copyright infringement claim we receive with the alleged infringer. In submitting a claim, you understand, accept and agree that your identity and claim may be communicated to the alleged infringer.

Counter Notification – Restoration of Material

If you have received a notice of material being taken down because of a copyright infringement claim, you may provide us with a counter notification in an effort to have the material in question restored to the site. Said notification must be given in writing to our DMCA Agent and must contain substantially the following elements pursuant to 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material that has been taken down and the original location of the material before it was taken down.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or if you are outside of the United States, that you consent to jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person or company who provided the original infringement notification.
  5. Send your counter notice through our Contact page or by email to [email protected]. Email is highly recommended.

Repeat Infringer Policy

We take copyright infringement very seriously. Pursuant to the repeat infringer policy requirements of the Digital Millennium Copyright Act, we maintain a list of DMCA notices from copyright holders and make a good faith effort to identify any repeat infringers. Those that violate our internal repeat infringer policy will have their accounts terminated.

Política de la Ley de Derechos de Autor del Milenio Digital (DMCA)

Bienvenido a hazelsocialmedia.com (el Sitio). Respetamos los derechos de propiedad intelectual de terceros, de la misma forma en que esperamos que otros respeten nuestros derechos. De conformidad con la Ley de Derechos de Autor del Milenio Digital (Digital Millennium Copyright Act), Título 17 del Código de los Estados Unidos, Sección 512(c), el titular de derechos de autor o su agente autorizado puede enviarnos una notificación de retiro de contenido a través de nuestro Agente DMCA indicado más abajo. Como proveedor de servicios de internet, tenemos derecho a acogernos a la inmunidad frente a dichas reclamaciones de infracción conforme a las disposiciones de puerto seguro (safe harbor) de la DMCA. Para presentarnos una reclamación de infracción de buena fe, debe enviarnos una notificación que contenga la siguiente información:

  3. La identificación del material infractor que debe ser retirado, junto con información razonablemente suficiente que permita al proveedor de servicios localizar dicho material. Por favor incluya la URL de la página en cuestión para ayudarnos a identificar la obra presuntamente infractora;
  4. Información razonablemente suficiente que permita al proveedor de servicios contactar a la parte reclamante, incluyendo su nombre, dirección física, correo electrónico, número de teléfono y número de fax;
  5. Una declaración de que la parte reclamante tiene la creencia de buena fe de que el uso del material no está autorizado por el titular de los derechos, su agente o la ley; y
  6. Una declaración de que la información contenida en la notificación es exacta y, bajo pena de perjurio, de que la parte reclamante está autorizada para actuar en nombre del titular de los derechos de autor.

El Título 17 USC §512(f) establece sanciones civiles por daños y perjuicios, incluyendo costas y honorarios de abogados, contra cualquier persona que, a sabiendas y de manera sustancial, tergiverse información en una notificación de infracción conforme al 17 USC §512(c)(3).

Contranotificación – Restauración del Material

Si usted ha recibido una notificación de retiro de material debido a una reclamación por infracción de derechos de autor, puede enviarnos una contranotificación con el fin de que el material en cuestión sea restaurado en el sitio. Dicha notificación debe presentarse por escrito ante nuestro Agente DMCA y debe contener sustancialmente los siguientes elementos, de conformidad con el 17 USC Sección 512(g)(3):

  1. Su firma física o electrónica.
  2. Una descripción del material que ha sido retirado y la ubicación original del material antes de su retiro.
  3. Una declaración bajo pena de perjurio de que usted tiene la creencia de buena fe de que el material fue retirado o deshabilitado como resultado de un error o de una identificación incorrecta del material a retirar o deshabilitar.
  4. Su nombre, dirección y número de teléfono, junto con una declaración de que usted acepta la jurisdicción del tribunal federal de distrito correspondiente al distrito judicial en el que se encuentra su dirección (o, si se encuentra fuera de los Estados Unidos, que acepta la jurisdicción de cualquier distrito judicial en el que pueda encontrarse el proveedor de servicios), y de que aceptará la notificación del proceso judicial por parte de la persona o empresa que presentó la notificación de infracción original.

Política de Infractores Reincidentes

Nos tomamos muy en serio la infracción de derechos de autor. De conformidad con los requisitos de la política de infractores reincidentes de la Ley de Derechos de Autor del Milenio Digital, mantenemos un registro de las notificaciones DMCA recibidas de los titulares de derechos y realizamos esfuerzos de buena fe para identificar a los infractores reincidentes. Quienes violen nuestra política interna de reincidencia verán sus cuentas canceladas.
